A gang attacked a man with metal bars and pieces of wood outside his house – following a row about barbecue parties.

Two of the six men involved in the frightening assault in Wath-upon-Dearne last July have now been jailed for their part in the attack during which their victim was knocked unconscious and badly injured.

The victim said he had been living ‘like a prisoner in his own home’ following the attack that involved one of his neighbours.

Danny Hare and Jack Houlton were both jailed at Sheffield Crown Court after admitting assault occasioning actual bodily harm.

Ian Goldsack, prosecuting, said the victim’s rear garden backed onto the neighbouring property lived in by Hare, who had moved in a few months before the attack.

He said after a number of ‘minor or petty’ disagreements between them, on June 30 Hare had hosted a ‘noisy barbecue’ in which water balloons were thrown towards the victim’s open kitchen window.

Mr Goldsack said when the man asked them to stop,‘threats and abuse’ were shouted towards him.

The man hosted his own family barbecue on July 4 which ended around 10.30pm.

Mr Goldsack said shortly after midnight a man had gone to the victim’s house and repeatedly banged on the front door.

The man left after the victim said he would call the police.

Shortly after, the man left the house to walk his aunt home but six men came out of a passageway and chased him as he tried to run home.

Mr Goldsack said: “As he got to the front door, he tried to grab the door frame but felt his legs being pulled away.

“There was then a heavy blow to the back of his head and he could hear shouts of ‘Get him out of the house’.

“He thinks he lost consciousness.

“He came to in the front garden and his stepson and aunt were pulling him towards the house.”

Mr Goldsack said the man recalled being hit numerous times.

He said the victim was a self-employed builder who had at least six weeks off work because of the injuries, which included a fractured cheekbone, double vision and nerve damage.

The 36-year-old said he had been ‘living like a prisoner in my own house’ following the attack and knowing some of the people that attacked him were still at large.

Dermot Hughes, representing Houlton, said his client was now ‘remorseful’.

He said: “He has expressed sorrow for what happened to the victim. It must have been an awful attack.”

The court was told Hunt hoped to have his sentence suspended so he could return to Sheffield to live with his mother and restart working.

Judge Julian Goose QC said: “This was a frightening attack in front of his family and friends. This has caused him considerable harm.”

Hare, 28, of Bushfield Road, Wath-upon-Dearne, was jailed for two years.

Houlton, 26, of Trough Drive, Thrybergh, was given a lesser sentence of 20 months’ imprisonment because of his earlier guilty plea.

A thug out celebrating his ‘lenient’ court sentence left a shop worker cowering and crying in front of her children in a sickening attack.

Kieron Wright was given a community order in March for his part in a cowardly assault that left a man with learning difficulties battered and bleeding in a pub toilet in Sunderland.

Within 24 hours of walking out of court the 19-year-old, who was given an ASBO in 2010, had turned his violence on Syeda Chowdhury, known as Sally, at a store in the city.

Newcastle Crown Court heard yesterday during the terrifying attack the victim had chunks of her hair pulled out and vile racist abuse was thrown at her.

Wright was handed a suspended sentence for his latest attack by Judge Roger Thorn QC.

The mum-of-four has been told it could take two years for her missing hair to grow back.

Prosecutor Richard Herrmann told the court the violence flared when Mrs Chowdhury confronted Wright over a pack of pork scratchings he had walked out of the store with but not paid for.

As the trouble spilled outside Mrs Chowdhury ended up standing at the door of her nearby home and her children came out.

Mr Herrmann said: ‘The defendant became racially abusive to her, throwing punches in her direction.

‘Two other people became involved, one who was convicted of threatening behaviour

‘The complainant describes she was very upset during the incident.

‘She was shaking, crying and chunks of her hair were on the ground.

‘Her children were screaming at the distress of the situation.’

Wright, of no fixed address, admitted breaching the original community order, breach of an antisocial behaviour order and affray.

Judge Thorn said: ‘He got what he thought was a lenient sentence and went out to celebrate to such an extent he committed the affray.’

Tony Hawks, defending, said Wright has been in Durham jail since March, which he has found an ‘intimidating experience.’

Judge Thorn said because Wright has spent the equivalent of a 12-month sentence on remand his 12-month prison sentence for the offence will be suspended for 18-months, with supervision.

The judge told him: ‘Newcastle Crown Court, in your view clearly, gave you a lenient sentence that you were not expecting.

‘I’m not going to express my own view of that because I don’t know the circumstances in which you were sentenced.

‘You went out and celebrated in a completely foolish way and committed further offences.’

As Wright left the court Judge Thorn warned him: ‘The last thing you ought to do is go and celebrate.’

A pub worker who tried to erase incriminating CCTV following the stabbing of a pub worker has been jailed.

Jamie Mulcahy, 26, was left ‘seriously brain damaged’ after he was attacked in Bacup, Lancashire, by pub manager Jonathan Wrigley in November 2014.

He had been receiving round-the-clock care until he passed away on December 5 last year .

Kyle Pakes, of Lennox Walk, Heywood , was instructed by Wrigley the morning after the attack to delete CCTV from the pub which showed the incident outside and Wrigley changing his clothes and washing his blood-covered hands in the sink, Burnley Crown Court heard.

But the court heard that he failed to carry out the task despite receiving telephone instructions from a CCTV engineer and it was later deleted by Wrigley’s cousin Curtis Munro.

Pakes, 22, pleaded guilty to perverting the course of justice and was jailed for 10 months.

Stephen Parker, prosecuting, told the court how Wrigley stabbed Mr Mulcahy with a ‘butterfly knife’ during a 20-man town centre fight and then ‘made various attempts to foil the police investigation, one of which involved the actions of this defendant’.

The court heard Wrigley contacted the engineer who had installed the CCTV.

Mr Parker said: “He told the engineer something about his girlfriend and not wanting her to see it and that there may well have been some infidelity.”

Pakes later called the engineer from the pub.

Mr Parker added: “He said Pakes seemed unable to read properly and came across as a bit thick.

“He was really struggling with the man he was speaking to who was struggling to understand the system.”

The court heard Pakes became ‘frustrated’ after two or three minutes and told the engineer to ‘just leave it’.

Munro then went round to the pub and spoke to the engineer for around 10 minutes about deleting the CCTV.

Mr Parker said: “It was believed at the time that Munro had been successful but a technical expert for the police managed to retrieve it.”

Wrigley, 34, of Todmorden Road, Bacup, pleaded guilty to wounding and was jailed for 13 years and six months in July .

Munro, 21, of Queen’s Park Road, Heywood, pleaded guilty to perverting the course of justice and was jailed for 16 months at the same hearing.

Judge Ian Leeming QC said it was an ‘extremely serious offence’ and there ‘must be immediate custody’.

Sentencing, he said: “This is a very serious offence but less grave than Munro as there was not the same determined effort and it didn’t work.

“You set about the task maybe out of misplaced loyalty. You were not very skilled at this, even under instruction. The engineer doubted your intellectual capacity and ability generally.

“I accept you’re genuinely remorseful.

“It’s very rare for a sentence for this offence to be suspended and it’s clear that neither a community order nor a fine could be justified. There must be immediate custody.”

Philip Holden, defending, said Pakes was Wrigley’s ‘first port of call’ because he knew he would be an ‘easy touch because of his intellect’.

He said: “Wrigley was a man in his 30s who deliberately sought out this defendant for those reasons.

“Wrigley didn’t want to be anywhere near that pub and wanted to continue to distance himself from it. He was working at the pub and knew his way around it.

“It was a pretty amateurish and poor attempt.”

A LEADING member of the English Defence League is still on the run after he was jailed for 18 months in his absence.

Dean Kenney, 41, from Bannister Green Villas, Felsted, had already admitted to violent disorder at the 2,000-strong EDL rally in Birmingham city centre in July 2013, along with 15 co-defendants.

But he failed to appear at Birmingham Crown Court for sentencing on January 5 and is believed to have fled the UK.

A spokesman for West Midlands Police said he is on their wanted list, but is no longer being actively pursued.

At the moment, Kenney only faces the violent disorder sentence, but failing to appear before the court can be a separate offence.

In July 2013 members of the far-right organisation clashed with 300 anti-fascist counter-demonstrators and police in Birmingham city centre.

Missiles were thrown, including bottles and rocks, with an estimated £6,000 of damage caused to a hotel.

A ‘horrific’ South Yorkshire paedophile who raped two vulnerable young children after buying them sweets has been jailed for 20 years.

James Andrew Swindlehurst, 43, of Rockingham Street, Honeywell, Barnsley was sentenced at Leeds Crown Court after being found guilty of 13 non-recent counts of rape and indecent assault of a child.

Swindlehurst denied the offences against two victims that spanned a five-year period during the 1990s and 2000s.

He was found guilty by a jury following a trial at Sheffield Crown Court in October.

Detective Constable Elinor Duke, leading the investigation, said: “This man took advantage of the fact that the children were vulnerable.

“He gained their trust by building a friendship with them and making them feel ‘needed’.

“He would buy them sweets and take them out before carrying out a prolonged period of sexual abuse, telling them that there was no point telling anyone as nobody would believe them.”

The victims made a disclosure to police in April 2014 and Swindlehurst was arrested and a full investigation was carried out.

DC Duke added: “The bravery that the victims have shown in coming forward is exceptional.

“They did it with the motivation to prevent Swindlehurst hurting any other children.

“It is testament to the courage of the victims that he is now facing 20 years behind bars and I hope today’s sentencing sends a message that we will take action and catch those responsible for such horrific acts.”

A PRIMARY school girl was sexually exploited to feed the sickening fantasies of a high-risk sex offender and his partner.

Sickening pictures of the little girl were shared by her abusers – convicted sex offender Michael Kinnear and Caroline Shaw – and distributed.

Shaw, 29, formerly of Thornton Road, Morecambe, now of Meldon Road, Heysham, and Kinnear, 47, latterly of Fairfield Avenue, Blackpool, pleaded guilty to inciting a youngster to be involved in pornography worldwide.

Kinnear was given a nine-year extended sentence including five years and four months in custody, while Shaw was jailed for two years eight months.

The court heard in a “lengthy graphic” messenger conversation retrieved by police, Kinnear asked Shaw if she would prefer to sexually assault and kill the little girl or someone’s newborn daughter.

Six police officers involved in the probe were in the public gallery.

Judge Christopher Cornwall said: “Those photographs should never have come into existence.”

To Kinnear he said: “I’m wholly satisfied you are a very dangerous offender.”

Both admitted offences of possessing and distributing indecent pictures, some at the highest level of indecency.

Shaw further pleaded guilty to taking an indecent picture of a child and neglect after a probe found she took 21 images of the girl.

All the offences took place at Morecambe between October last year and May this year.

The little girl told police officers Shaw had taken ‘rude pictures of her’ and that ‘made her feel sad’.

Peter Barr, prosecuting, said: “Kinnear is described as a high-risk registered sex offender who was sentenced in 2010 to sexual activity with a child under 16 and detaining a child without lawful authority.

“On May 18 this year two police officers carried out an unannounced home visit. They noticed a white Sony mobile on the sofa which he at first denied belonged to him and then said he had bought it a month earlier.

“He consented to them looking at phone and said he was aware there were indecent images on the mobile.”

Officers found a message in which he asked the other party to “send images” and the other party had sent two images to him. A second HTC phone was also seized.

The Sony phone had a ‘highly-sexualised’ conversation between Kinnear and Shaw about the abuse of children.

The court heard Shaw was arrested and they seized her Samsung mobile tablet and some memory cards.

Shaw later claimed she had been ‘coerced’ by Kinnear and Judge Cornwall said: “You came under Kinnear’s utterly malign influence.”

Further analysis of messages showed Kinnear had requested other adults send him images of little girls

Defending Shaw, Janet Ironside argued Shaw, who is previously of good character, was not sexually motivated by her crimes.

She said she had been groomed by Kinnear, had low self confidence, had been bullied at school and had learning difficulties that were previously undiagnosed.

Defending Kinnear, Fraser Livesey said his guilty plea was entered at the first opportunity.

He revealed he would spend the rest of his sentence in segregation after being seriously assaulted by two inmates. Both are subject to sex offender prohibitions.

A THUG who targeted two strangers in a racist attack in Orford leaving one of the victims unconscious and in desperate need of hospital treatment is now behind bars.

Ryan Swindells, aged 20, of East Avenue, Orford, was handed a three year sentence after pleading guilty to a section 20 assault and affray.

The court heard how two men of Iraqi-Kurd origin were walking along Orford Lane on April 4 at 6.40pm when they heard shouting and swearing from a group of men on the other side of the road.

One of the men – later identified as Swindells – could be heard shouting racist abuse and crossed the road to approach the two men.

Prosecuting Paulinus Barnes said: “One of the victims thought if he was nice to him he would walk away but the other males were encouraging him.

“He then put his head towards one of the victims in a threatening manner.”

A fight broke out with at least four others getting involved in the street brawl.

At one point CCTV showed three men kicking one of the victims while on the floor.

One of the victims later lost consciousness and had to be put in the recovery position by a member of the public – his face covered in blood from the attack.

The victim was taken to Aintree Hospital where he was treated for head injuries and a fractured collar bone.

Defending Swindells, David James said both the defendant, who has struggled with binge drinking and a cocaine habit, and the victims were ‘giving as good as they can get’ during the fight.

He added: “Having spoken to this young man this is not a man who is proud of his actions.

“He is embarrassed by them and he is disappointed he is in court again.

“He is deeply ashamed he has used racist terms as he does not feel he is an ingrained racist.”

Swindells has a number of previous convictions – one racially aggravated.

Declan Jenks, aged 21, of Alder Lane, and Joshua Williamson, aged 21, of Marsh House Lane, were also sentenced at Warrington Crown Court on Friday for their involvement in the brawl.

Jenks was sentenced to two and a half years in prison after admitting a section 20 assault, affray and breach of a suspended sentence.

Williamson pleaded guilty to affray and must carry out 160 hours of unpaid work, 35 days of rehabilitation activity and a thinking skills programme.

The court heard how Jenks, who has a previous convictions for drunk and disorderly and assault occasioning actual bodily harm, originally became involved in the fight to break it up.

Defending Jenks, John Banasko, said: “Unfortunately initially he had good intentions effectively to assist Mr Swindells as he was originally in the minority but he did become involved and he did throw punches.”

He added that he was not involved in the racist abuse and did not kick the victims.

Williamson, who has a previous conviction for a public order offence in 2014, did not throw any punches and was not involved in the racist abuse but chased one of the victims up the street.

Defending Williamson, Michael Whitty said apart from one previous conviction, the defendant’s behaviour was ‘out of character’.

He said: “He is a young man and he clearly has ideas about what he wants to do during his life.

“When it is the right time he wants to join the marines. He has ideas for his life that does not involve coming back to court.”

Sentencing, Judge Nicholas Woodward said this would have been a ‘disturbing incident’ for members of the public to witness.

He added: “It started with Swindells making racist comment towards them for no apparent reason.

“Not content with that you [Swindells] then came over from the opposite side of the road towards them and they were trying to diffuse the situation but you were clearly looking for a fight.

“In a macho way you put your head towards his showing aggression.

“When they did not respond you started to punch out.”

THE MUM of Lee Swindells was forced to apologise to a judge after lashing out as her son was led down to the cells.

While Ms Swindells could have faced proceedings under the Contempt of Court Act following her verbal outburst the judge decided only to issue her with a warning after she apologised for her actions.

Ms Swindells could be seen crying in the dock after spending part of the afternoon in the cells while she waited to find out her fate.

A ʻBULLYʼ who preyed on vulnerable adults in South Derbyshire and threatened them at knifepoint for cash has been jailed for eight years.

Gareth Pipes, 25, from Swadlincote, stole £1,500 in cash from one victim and attempted to steal a social security giro from another man who was subjected to a terrifying ordeal in his own home.

Pipes, of no fixed abode, attended a hearing at Derby Crown Court to admit charges of false imprisonment, blackmail, robbery and possessing a knife in public.

The court heard that Pipes coerced his first victim, from Overseal, into accompanying him to a bank in High Street, Swadlincote, on September 14 last year, threatening him with a knife and forcing him to withdraw £1,500 in cash, which he then stole. The money was never recovered.

In a second incident, on October 17, he visited the home of another man in Hartshorne, again threatening him with a knife and demanding he hand over his giro before the victim fled without handing over the cheque.

It is understood that both victims were known to the offender.

Detective Sergeant Ian Louch, from Swadlincote police station, welcomed the lengthy sentence the court handed to Pipes.

He told the Mail: “Gareth Pipes was sentenced for offences where he picked on vulnerable people and through threats of violence attempted to obtain money from them.

“He is a very dangerous man who preyed on the vulnerability of adults in the Swadlincote area. He is basically a bully.

“We were pleased with the sentence as it puts across the message that people will not be allowed to get away with committing these kinds of offences.”

A MAN who threatened police with a fake gun has been has been jailed for two-and-a-half years.

Gareth Pipes was given 16 months for making a threat to kill and 16 months for possessing an imitation firearm.

A Derbyshire police spokeswoman said Pipes was wanted on recall to prison and on February 5, he called Matlock Police Station and asked to speak to a sergeant. When he was transferred to a sergeant, he made threats to kill him.

On February 7, officers visited a house in Overdale, Matlock, while searching for Pipes.

When they entered the house, Pipes produced a gun and threatened them. The officers arrested him and seized the gun, which was later found to be fake.

Pipes, 30, of no fixed abode, pleaded guilty to both crimes and was sentenced at Derby Crown Court on Monday, March 9.

A thug who threw a bin and traffic cone at a Doncaster takeaway delivery driver’s car before he and two others set upon him in a ‘horrific attack’ has been jailed.

Kane Moffatt, aged 22, kicked the Mexborough man repeatedly in the horror assault, which he carried out alongside 20-year-old Philip Temperton and a 17-year-old boy who cannot be named for legal reasons.

The violent trio admitted assault occasioning actual bodily harm at Sheffield Crown Court. Temperton was also jailed.

Just after midnight on October 4 last year, the 17-year-old chased the delivery driver’s vehicle down Mexborough High Street until it pulled up outside a fast food outlet.

The driver went inside the shop, but when he came out the three men punched him to the floor before Moffatt and Temperton kicked him repeatedly.

Another man, who had been in the shop, came outside to try to help the victim, but Moffat and the 17-year-old then began to attack him too. He escaped and ran back into the shop.

Moffatt then threw several items at the victim’s car, including a traffic cone and a bin, before the 17-year-old punched the car window.

The three then fled the scene, leaving the ‘distressed’ man on the floor.

They were arrested in November 2014 and entered not guilty pleas on their first court appearance in January.

But they changed their pleas to guilty and were sentenced on Friday.

Moffatt and the 17-year-old had also admitted common assault.

Moffatt, of Hawthorne Crescent, Mexborough, was sentenced to 16 months in prison and Temperton, of Arnold Crescent, Mexborough, was jailed for ten months.

The 17-year-old Doncaster boy was given a 12-month youth rehabilitation order.

Investigating officer Det Con Della O’Horo said after the court hearing: “This was a horrific attack on a man, and his friend who tried to help, for no reason whatsoever.

“The actions of these three that night are absolutely deplorable.

“Fortunately, the two victims did not sustain any serious injuries as a result of this violent assault, however the delivery driver has been extremely distressed by the incident.

“I hope residents in Mexborough feel some form of reassurance that we will not tolerate any form of criminality or violence and will do all that we can to bring offenders in the town to justice.”
