VICTIM’S father hits out as right-wing yob is let off with community service and avoids being placed on sex offenders’ register.

FURY erupted after a right-wing yob who groomed a 13-year-old girl online before having sex with her avoided jail and a place on the sex offenders’ register.

A court heard Stephen Payne had sex with the teenager at his home after the youngster made clear to him during Facebook chat that she was under age.

But the 19-year-old was given only a community payback order after he admitted sex with a minor.

The young victim’s furious father yesterday blasted the 100-hour sentence.

He said: “I am absolutely bewildered that something of this severity gets you 100 hours’ community service and no place on the register.

“What exactly is the sex offenders’ register for? You could get a heftier punishment than this for fighting at the football.”

Local MSP Helen Eadie was also appalled by the sentence and has written to Lord Advocate Frank Mulholland to voice her concerns.

Payne – who “likes” the far-right Scottish Defence League on his Facebook page – got into online conversation with his young victim in 2011.

During their chat, she told him she was 14, although she was only 13 at the time.

She later went to his home in Rosyth, Fife, where they had sex in September 2011.

The girl’s parents found out about the incident last April and her mother contacted police, who launched an inquiry.

Payne was subsequently arrested and charged. He pled guilty after his Facebook conversation with the girl was traced.

At Dunfermline Sheriff Court on January 16, Payne admitted having sex with a minor.

But Sheriff Ian Abercrombie QC sentenced him to only a 100-hour community payback order.

The girl’s dad added: “I would like him on the register and everyone in the locality to know what kind of person is at liberty to walk the streets.”

TWO men jailed for sexual activity with 14-year-old girls had been thrown out of the British National Party when their offences came to light, it has been revealed.

Ian Richard Hindle, 32, of Church Walk, Blackburn, and Andrew Paul Wells, 49, were jailed on Thursday for a total of five years and three months.

Preston Crown Court heard the pair had plied the girls with alcohol at Wells’ flat on Infirmary Street in Blackburn.

Both men had been BNP members up until they were arrested for the offence, said local party organiser Robin Evans.

He said: “They didn’t have any sexual offences when they became members. As soon as it was brought to our attention – as soon as they were arrested – they were both expelled.

“If it was up to the BNP they would have got a lot longer.”

Mr Evans said the pair were not involved in the running of the local party.

He added: “They just turned up to meetings. We are glad to be rid of them”.

Hindle, who pleaded guilty to unlawful sex with a child, was jailed for three years.

The court heard that when Hindle had first met the girl she had lied about her age, but that he had discovered the truth before having sex with her.

Wells, of Infirmary Street, Blackburn, who was jailed for two years and three months, had earlier pleaded guilty to two counts of engaging in sexual activity with a child and one of engaging in sexual activity in the presence of a child.

Last week the names and addresses of more than 250 East Lancashire BNP members were included in the document that was posted on the internet this week.

Nationally, there were 12,000 people on the list, including police officers, teachers and soldiers.

Mr Evans said some people he knew on the list had received threatening phonecalls.

A HUSBAND and wife are waking up behind bars after luring a Blackpool girl and keeping her in their home, where the man sexually abused her.

Michael Kinnear, 41, and Nicola Kinnear, 40, admitted detaining the 13-year-old in their terraced house on Fairfield Road in North Shore.

After being lured into the couple’s home with the promise of shelter and food, the youngster, who was in foster care, was sexually touched by Michael Kinnear.

A judge at Preston Crown Court described their actions as “classic grooming” and said they should have informed the authorities of her whereabouts.

Police began the hunt for the 13-year-old girl in April last year after her concerned Blackpool foster parents reported her missing.

The youngster was found six days later in Kinnear’s house.

Officers had already called at the house and been told she was not there.

DC Andy Rigby, from Blackpool Police and Blackpool Council’s Awaken Team, a project to tackle the exploitation of vulnerable children, said: “This young girl who was in foster care wasn’t happy with her placement and got introduced to these two through a mutual teenage friend.

“She was there for six days and they didn’t contact anybody, hence the child abduction. While there, Michael Kinnear has committed sexual activity with her.

“The judge described it as classic grooming – they gave her free reign and no rules, they fed and clothed her during the week.”

Police were able to track the teenager’s whereabouts after tracing a mobile phone she had used to call a missing person’s helpline to the Kinnears’ address.

DC Rigby added: “We visited their address, while knocking on doors, and they had denied all knowledge of anything. Then we traced the mobile phone to that address and when we went round again, they still denied it. “Eventually they said ‘she’s here’.

“She saw them in the first instance as a place of shelter, but clearly they had other ideas, hence the sentences.

“She wasn’t locked in the house, they just allowed her to stay there. It’s very important a message is sent out to children – nobody does anything for nothing. You have to take a step back and think ‘what is the ulterior motive’.”

The teenager has now left Blackpool and police say she has settled back into care and is “putting it behind her”.

Michael Kinnear was sentenced to 33 months in prison after pleading guilty to detaining a child so as to keep her from a person having lawful control and engaging in sexual activity with a child.

Nicola Kinnear was handed a 16-month jail term for detaining a child.

DC Rigby added: “This has been a complex and difficult investigation but I am pleased with the sentence.”

The couple did not plead guilty to the offences until the trial began. Michael Kinnear was placed on the sex offenders register for seven years and given a 10-year Sex Offenders Prevention Order.
